Datenschutz

Diese Erklärung beschreibt, welche Daten die iPad-App Elite Dent verarbeitet. Sie ist in einfacher Sprache gehalten und an die DSGVO (Anwendbarkeit in Deutschland) angelehnt. Es werden keine Zertifizierungen behauptet, die nicht vorliegen. Bei Abweichungen gilt die deutsche Fassung.

2. Wofür die App da ist

Elite Dent ist eine Fachanwendung für Zahnarztpraxen und Dentallabore (iPad). Sie ist kein Patientenportal und kein diagnostisches Medizinprodukt. Verarbeitet werden nur Daten, die für den Labor-Fallablauf nötig sind: Akten, Scans, Farbe, Form, Fotos, Chat, Export.

3. Welche Daten wir erheben

Das entspricht der Privacy-Angabe der App (PrivacyInfo.xcprivacy) und dem tatsächlichen Funktionsumfang. Zweck jeweils: App-Funktion, nicht Werbung. Kein Tracking, keine Werbung, kein Verkauf von Daten (NSPrivacyTracking ist false).

Apple-Privacy-Typen in der App (verknüpft mit dem Konto, nicht für Tracking): Name, E-Mail, Telefonnummer, Fotos/Videos, Gesundheitsdaten, Benutzer-ID — jeweils zum Zweck „App-Funktionalität“.

4. Zwecke

Ausschließlich der Betrieb des zahntechnischen Fallablaufs: Anmeldung, Akten, Qualitätsprüfung, Farb- und Formarbeit, Austausch Praxis↔Labor, DATEV/XML-Export, Offline-Nutzung am Stuhl. Keine Marketingprofile, keine Drittanbieter-Werbung.

5. Rechtsgrundlagen und Rollen

Kontodaten der Zahnärztinnen/Zahnärzte und des Labors: in der Regel Art. 6 Abs. 1 lit. b DSGVO (Vertrag über die Nutzung der App) sowie lit. f (sicherer Betrieb), soweit anwendbar.

Gesundheits- und Patientendaten (Art. 9 DSGVO): Die Praxis gibt diese Daten ein im Rahmen der Behandlung. Elite Dent hostet sie, damit die App funktioniert:

Echte Patientendaten gehören nur in die Produktionsumgebung der Praxis, nicht in Demo-Konten.

6. Speicherung und Sicherheit

Zugriff in der App ist rollenbasiert (Praxis sieht eigene Patientinnen/Patienten; Labor den Fallablauf).

7. Speicherdauer

Kontodaten: für die Dauer des Nutzungsvertrags sowie danach, soweit handels- oder steuerrechtliche Aufbewahrungspflichten bestehen (in Deutschland regelmäßig 6 bzw. 10 Jahre).

Patienten- und Falldaten: nach Weisung der Praxis als Verantwortliche und nach anwendbaren berufsrechtlichen Aufbewahrungspflichten in Deutschland (für zahnärztliche Dokumentation häufig zehn Jahre nach Abschluss der Behandlung). Nach Vertragsende mit einer Praxis löscht oder übergibt Elite Dent die gehosteten Falldaten nach den im AVV festgelegten Fristen, soweit keine gesetzliche Pflicht entgegensteht.

8. Empfänger und Auftragsverarbeiter

9. Ihre Rechte

Soweit die DSGVO greift, können betroffene Personen verlangen: Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung (Art. 18), Datenübertragbarkeit (Art. 20) und Widerspruch, soweit Art. 21 greift.

Beschwerde: bei der zuständigen Aufsichtsbehörde. Für den Sitz in Pforzheim (Baden-Württemberg) ist das der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg (LfDI BW), Lautenschlagerstraße 20, 70173 Stuttgart. Alternativ der Bundesbeauftragte für den Datenschutz und die Informationsfreiheit (BfDI).

10. Kinder

Die App richtet sich nicht an Kinder. Nur berufliche Nutzerinnen und Nutzer mit Konto. Patientendaten Minderjähriger dürfen nur die Praxis im Behandlungsverhältnis eintragen.

11. Kontolöschung

In der App: Einstellungen → Konto löschen (Bestätigung mit DELETE und Passwort). Das entfernt das Benutzerkonto. Löschung oder Export von Patientenakten der Praxis zusätzlich per E-Mail an den Support, abgestimmt mit der Praxis.

12. Änderungen

Wir passen diese Erklärung an, wenn sich Verarbeitung oder Rechtslage ändern. Das Datum oben ist der letzte Stand.

Privacy Policy

This notice explains what the Elite Dent iPad app processes. It is written in plain language and aligned with the GDPR as it applies in Germany. We do not claim certifications we do not have. If translations differ, the German text prevails.

2. What the app is

Elite Dent is a professional app for dental clinics and labs (iPad). It is not a patient-facing product and not a diagnostic medical device. We process data only as needed for the lab case workflow: records, scans, shade, shape, photos, chat, and export.

3. What we collect

This matches the app’s privacy manifest (PrivacyInfo.xcprivacy) and the features actually used. Purpose: app functionality, not advertising. No tracking, no ads, no sale of data (NSPrivacyTracking is false).

Apple privacy types declared in the app (linked to the account, not used for tracking): name, email, phone number, photos/videos, health, user ID — each for “App Functionality”.

4. Why

Only to run the dental-lab case workflow: sign-in, records, quality checks, shade and shape work, clinic↔lab communication, DATEV/XML export, and chairside offline use. No marketing profiles, no third-party ads.

5. Legal bases and roles

Account data for dentists and lab staff: typically GDPR Art. 6(1)(b) (contract to use the app) and, where applicable, Art. 6(1)(f) (keeping the service secure).

Health and patient data (Art. 9): the clinic enters this data in the course of care. Elite Dent hosts it so the app can run:

Real patient data belongs only in the clinic’s production environment — not in demo accounts.

6. Where data lives and how it is protected

In-app access is role-scoped (clinic staff see their patients; the lab sees the case workflow).

7. Retention

Account data: for the life of the service contract and thereafter as required by German commercial and tax retention rules (typically 6 or 10 years).

Patient and case data: as instructed by the clinic as controller and as required by applicable German professional retention duties (dental treatment records are commonly kept for ten years after treatment ends). After a clinic contract ends, Elite Dent deletes or returns hosted case data according to the AVV, unless a legal duty requires keeping it.

8. Recipients and subprocessors

9. Your rights

Where the GDPR applies, data subjects may request access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), portability (Art. 20), and objection where Art. 21 applies.

You may lodge a complaint with the competent authority. For the establishment in Pforzheim (Baden-Württemberg) that is the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg (LfDI BW), Lautenschlagerstraße 20, 70173 Stuttgart. Alternatively the Federal Commissioner for Data Protection and Freedom of Information (BfDI).

10. Children

The app is not directed at children. Professional account holders only. A clinic may record a minor’s patient data only in the course of treatment.

11. Account deletion

In the app: Settings → Delete account (confirm with DELETE and the password). That removes the user account. Deletion or export of the clinic’s patient records is handled by emailing support, coordinated with the clinic.

12. Changes

We will update this notice if processing or the law changes. The date at the top is the current version.
